A preliminary criminal inquiry by New York City’s Department of Investigation and the Manhattan district attorney’s office, opened in mid-July 2026 shortly after two load-bearing columns buckled during the office-to-residential conversion at the former Pfizer headquarters on East 42nd Street, has yet to produce charges more than six weeks later. Engineers have attributed the localized failure to omitted steel reinforcement in the added structure, prompting civil violations, building stabilization work, and broader safety sweeps by the Department of Buildings. Criminal liability in such construction cases typically requires clear evidence of intent or gross negligence beyond design errors or shortcuts, thresholds that remain unproven amid an ongoing but early-stage probe involving multiple contractors and developers. With no major developments since July and resolution focused on administrative or civil outcomes, traders see limited likelihood of charges by year-end.
